This past week, 41 year-old Michael Gaeta of Auburn, New York, was sentenced for driving drunk with two children in the backseat earlier this year. Gaeta’s sentence allowed him to escape prison time, but includes restrictions on driving, community service and probation.
On April 28, 2013, Michael Gaeta picked up the two children of his fiancée. Gaeta was driving because his fiancé had a bad reaction to alcohol and medication and was unable to drive. Gaeta had been working as a DJ at a gig earlier in the night, which is where he consumed alcohol. When Gaeta was arrested by Auburn Police, marijuana was also discovered in the back of his car.
Gaeta was charged with two counts of aggravated driving while intoxicated with a child under the age of 15 in the vehicle, a Class E felony, one count for each of the children. The two children were 4 and 5 years old.
On September 12, 2013, Gaeta admitted to driving drunk and pleaded guilty to the felonies in front of a Cayuga County judge. Gaeta’s attorneys asked for leniency, pointing out that this was a first offense and that Gaeta acknowledges that he made a “terrible mistake” under pressure from his fiancé. In lieu of prison time, Gaeta was sentenced to five years of probation, sixty days of community service and the revocation of his license for at least one year.
Gaeta’s vehicle will also have an ignition interlock device for the duration of probation, and Gaeta will pay a monetary fine of $2500 and complete a drinking and driving prevention program.
